Complaint
The complainant said that the product claimed to increase broadband capability and considered it to be just a not very good extender which gave the worse signal than hub itself.
Response
The advertisers did not provide a response to the complaint.
Conclusion
Complaint Upheld
The Complaints Committee considered the detail of the complaint and the advertisers’ response. The Complaints Committee expressed concern at the advertisers’ failure to respond to the complaint. They reminded them that there is an onus on advertisers to ensure that their advertising is in conformity with the Code.
The Complaints Committee noted that substantiation had not been provided to demonstrate that the product had the advertised effect. As substantiation for the claims had not been provided and in the absence of a response from Balou Management Ltd, the Committee concluded that the advertisement was in breach of Code sections 3.10, 4.1, 4.4, 4.9 and 4.10.
