Complaint
The Institute of Professional Auctioneers & Valuers objected to the use of the IPAV and TEGoVA designatory letters being used by the advertiser as they were no longer a member of IPAV and consequently was no longer a TEGoVA Residential Valuer (TRV). They considered that the continued use of the designatory letters MIPAV TRV MCEI by Lloyd Daly was misleading advertising.
Response
The advertisers failed to provide a response to the complaint.
Conclusion
Complaint Upheld.
The Complaints Committee considered the detail of the complaint. The Committee expressed concern at the advertisers’ failure to respond to the complaint. They reminded them that there is an onus on advertisers to ensure that their advertising is in conformity with the Code.
In the absence of a response from Lloyd Daly, the Committee concluded that the use of the designatory letters was in breach of Code Sections 3.10, 4.1, 4.4, 4.9 and 4.10.
ACTION REQUIRED:
The advertising must not reappear in its current form.
