The advertisement was seen as a post on Instagram and depicted an image of a model dinosaur standing over three white eggs. The caption of the post read:

Complaint
The complainant considered the advertisement to be misleading as they said that on enquiring about the complimentary night’s stay offer, they were informed that the offer was only available for stays during January to March 2024, Sunday to Thursday.
The complainant said that this information was not listed in the Instagram post and therefore created the impression that the offer of the stay could be redeemed on any night throughout the year.
Response
The advertisers said that having investigated the matter, they noted that the Instagram post in question should have stated ‘terms and conditions apply/subject to availability’.
They said that once a telephone enquiry was received in relation to the advertisement, the terms and conditions of the offer were clearly stated.
Conclusion
Complaint Upheld
The Committee considered that as the social media post advertising the offer did not clearly state the restrictions or terms and conditions of the offer nor directed consumers to these terms and conditions, this had the potential to mislead consumers. They therefore considered the advertising to be in breach of the Code at sections 4.01, 4.04, 5.15 (a)-(i), 5.16 and 5.17.
Action Required:
The advertisement must not reappear in its current form. The Complaints Committee reminded advertisers that terms and conditions should be clear, complete and easy for the consumer to understand.
