The advertising referred to the following:
“Our ultimate broadband bundle just got even better.
Unlimited Superfast Broadband
Superb TV
4G Mobile with Free EU Roaming
Unlimited home phone…”
Complaint
The complainant said that he considered the use of the word “Superfast” to be misleading as there was no qualification offered or any mention of average speeds. He stated his average speed was 25Mb which was well short of the 100Mbs advertised for some of the bundles offered.
Response
The advertisers failed to respond to the complaint.
Conclusion
Complaint Upheld
The Complaints Committee considered the detail of the complaint and expressed their concern at the advertisers’ failure to respond to the complaint. They reminded them that there is an onus on advertisers to ensure that their advertising is in conformity with the Code.
In the absence of a response from the advertisers the Committee considered the advertisement to be in breach of Section 3.10 of the Code.
The advertisers should not advertise in the same format again without having adequate substantiation for the claims made.
