Complaint
The complainant, a resident in the UK, won one of the prizes. She sent the advertiser an email to inform him of her win. The advertiser said that because she lived in the UK it would be easier to send her a supermarket voucher. Between June 2014 and January 2015 the complainant and advertiser exchanged emails, the advertiser said that he had sent the voucher, the complainant said she said she didn’t receive it. The advertiser then asked the complainant to pick a different gift to the value of €50 from a list of gifts he had provided a link to. The complainant chose her gift and to date she has not received it.
Response
The advertisers failed to provide a response to the complaint.
Conclusion
Complaint Upheld.
The Complaints Committee considered the details of the complaint and expressed their concern at the advertiser’s failure to respond in the matter. They reminded him that there is an onus on advertisers to ensure that their advertising is in conformity
with the Code. They also noted that more than a year had passed and the complainant had yet to receive her prize. In the circumstances the Committee upheld the complaint under Sections 2.7 and 3.33 of the Code.
Action Required:
The advertising must not reappear in its current form. The Committee also asked the advertiser to ensure that competition entrants to future promotions receive their prizes as per the requirements of the Code.
