The advertisement referred to the following:
“In just 3 mins RegisterMyCompany.ie will guide you through the steps necessary to register your company today:
Complete company Formation from only €149.00 +VAT 3 competitive packages to choose from.
Register your Business Name today for €49.00 +VAT
Vat Registration.
Virtual/Registered Offices and Telephony Services available
Guaranteed 3-5 day Incorporation”.
The advertisers then outlined the three packages which they provided.
• The Gold Package – €149.00 + VAT
• The Platinum Package – €199.00 + VAT
• The Diamond Package €239.99 + VAT
The common theme running through all the packages on offer was that they all offered a “3-5 Day Express Company Formation”.
Complaint
The complainant said that he paid the company concerned for their service and despite their promise of a timeframe of 3-5 days for express company formation, some 10 working days later he had not received the service which he had paid for. He considered that he had been misled by the advertising.
Response
The advertisers said that they would review the wording of the text on their website, adjust it accordingly and issue the required caveats where appropriate.
Conclusion
Complaint Upheld.
The Complaints Committee considered the details of the complaint and expressed their concern at the delay in receiving the advertisers’ response. They reminded them that there was an onus on all advertisers to ensure that their advertising is in conformity with the Code. In the circumstances the Committee upheld the complaint under Sections 2.7, 2.9, 2.22 and 2.24 of the Code.
Action Required:
The advertisement should not run in its current form again. The Committee also requested the advertisers to amend their website in a timely fashion.
