Complaint
The advertising came to the attention of the Secretariat through its general monitoring programme. The advertiser was asked for his comments on his advertising under the Health and Beauty Section of the Code.
Response
While a copy of the advertisement had been sent to the advertiser in the course of the investigation and the media involved identified, the advertiser contacted the Secretariat by email to ask them to identify the advertising to him to enable him to amend or remove it. No further comments were received.
Conclusion
Complaint Upheld.
The Complaints Committee considered the detail of the case and expressed their concern at the advertiser’s failure to respond to the complaint. They reminded him that there was an onus on him to demonstrate that his advertising was in conformity with the Code. They also noted that this was not the first instance of this style of advertising by the particular advertiser. In the absence of a response from the advertiser the Committee upheld the complaint.
Action Required:
The advertising must not appear in the same format again.
