Advertisment
The advertisement on the company webpage stated they were offering members of the three major health insurance providers a 15% discount off laser eye surgery and that there were finance options available.
The advertisement stated the following:
“*Prices above are all inclusive of 15% Health Insurance Discount”
Complaint
The complainant considered the advertisement to be misleading. She said that she was quoted a price without any discount applied. She was then told that the price included the 15% discount which was available to all customers. She considered that there was no additional discount available to members of health insurance companies .
Response
The advertisers failed to provide a response to the complaint.
Conclusion
Complaint Upheld
The Complaints Committee considered the detail of the complaint. The Complaints Committee expressed concern at the advertisers’ failure to respond to the complaint and reminded them that there is an onus on advertisers to ensure that their advertising is in conformity with the Code.
In the absence of a response to the complaint, the Committee noted that substantiation for the claims made in the advertising had not been provided. In the circumstances, they concluded that the advertisement was in breach of Code sections 3.10, 4.1 4.4, 4.9, 4.10, and 4.22.
