The press advertising published on 19th October referred to the following:
“Spend €25 = save €5 on your next €25 shop. The more you shop …the more you save. Redeem vouchers before Wednesday 22nd October.”
The footnote read:
“Terms and Conditions apply. See instore for details. All offers subject to availability & valid from 19.10.14 until 22.10.14 unless otherwise stated. Some offers available in selected stores only. Customer quotas may apply. See instore for details. Fruit & Veg offers excludes organic. Please Drink Sensibly.”
Complaint
The complainant said she shopped in Dunnes Stores to avail of the offer advertised. She spent €100 on her shopping and expected to receive €20 back in vouchers to redeem against her next shop by 22nd October. After purchasing her goods, however, she was informed that the shop had stopped giving out the vouchers the previous Thursday. She said this fact had not been referenced anywhere in the advertising and she considered therefore that she had been misled by its contents.
Response
The advertisers failed to respond to the complaint.
Conclusion
Complaint Upheld.
The Complaints Committee considered the detail of the complaint and expressed their concerns at the advertisers’ failure to respond in the matter. They reminded them that there was an onus on all advertisers to demonstrate that their advertising was in conformity with the Code. In the absence of the advertisers’ response the Committee upheld the complaint.
Action Required:
The advertisement must not run in its current form again.
