The advertisers’ website acts as a third party site for retailers and consumers to enable consumers to make savings. By using the fatcheese.ie website as a link to the retailer the consumer is offered the opportunity to make savings on their purchases. In this case the advertisers offered consumers the opportunity to avail of:
“€15.00 Cashback on Vodafone Prepaid new connection where your number is ported over.”
Complaint
The complainant said that he wished to avail of the Vodafone offer as advertised on Fatcheese.ie and clicked on the relevant link. He purchased a HTC Desire X handset and ported over a prepaid number from a different network. He said that he did not receive the €15.00 cashback as promised in the advertising and each time he tried to query this with the advertisers he received an automated response. He considered that he had been misled by the advertising in question.
Response
The advertisers did not respond to the complaint.
Conclusion
Complaint Upheld.
The Complaints Committee expressed their concern at the advertisers’ failure to respond to the complaint and reminded them that there was an onus on them to demonstrate that their advertising was in conformity with the Code. In the absence of the advertisers’ response the Complaints Committee upheld the complaint.
Action Required:
The adverting must not appear in its current format again.
