The eir fibre coverage map provided information on the eir fibre availability in the Meath area. The map was accompanied by the following text:
“Click to zoom in on our map and discover if eir fibre has arrived in your area.
This map is an illustrative guide only and not a guarantee of availability, for precise results, use or eir fibre availability checker below.”
Results for the complainants address stated:
“Great News! We can offer you the following great value bundles.
We checked [complainant’s address], Navan, Meath
Speeds of up to 50mb are available at your home.”
Three bundles were listed below and each included an eir fibre broadband product.
Complaint
The complainant considered that the results of the eir fibre coverage map for her address were misleading as she was advised by eir that fibre was not available at her address.
Response
While the advertisers initially acknowledged receipt of the complaint, they did not provide a response.

Complaint Upheld.
The Complaints Committee considered the detail of the complaint. The Complaints Committee expressed concern at the advertisers’ failure to respond to the complaint. They reminded them that there is an onus on advertisers to ensure that their advertising is in conformity with the Code. The Committee considered that the use of the term ‘precise results’ had provided users with an expectation that the results of this checker would be accurate.
In the absence of a response from eir the Committee concluded that the advertisement was in breach of Code sections 3.10, 4.1, 4.4, 4.9, 4.10 and 4.28 (a) of the Code.
ACTION REQUIRED:
The Complaints Committee told eir to remove the statement “precise availability” from their coverage map advertising if they were not in a position to provide accurate information for addresses entered.
